Services Agreement

Services Agreement/Contracto de Prestación de Servicios

This SERVICE AGREEMENT is made date of the transaction BETWEEN

  1. CARE FOR ME SL, the Service Provider, with CIF number B93493554, NICA 49337, corporate address at Urb. Calypso-C.c. Valdepinos 1 y 3ª, Mijas Costa, 29649, Mijas (Malaga) and business address at Edificio Edward King, Suite 305, Calle Ramón Gómez de la Serna, 22, 2960, Marbella (Malaga), telephone number 0034 952 636 900 and mobile 0034 682 870 120.
  2. The customer and the patient in relation to the transaction.


The Patient wishes to be provided by Care for Me SL with the services defined below, and both parties agree on the terms and conditions of this agreement.


1. Services Provided.

Care for Me can when requested provide the Patient with the following services:

1.1. Apply on behalf of the Patient to the Andalusian Health Service (SAS) to obtain the public medical health card (tarjeta sanitaria). If the application has to be done in person, we will accompany the Patient to the Local Health Office and assist them onsite dealing with the process. This service is provided on the premises that the Patient is eligible to avail ac-cess to the public health service. The service does not include applications to review the administrative decision if the patient is refused the public medical health card.

1.2. Advise on how to avail on the subsidised Government medication Scheme.

1.3. Help the Patient to choose the GP in their Local Health Office or doctors covered by their Private Health Insurance.

1.4. Set appointments with the Client´s GP/Doctors.

1.5. Assist the patient at the doctor´s/hospital appointments. Care for me SL will explain the Patient´s condition to the doctor and help the Patient to communicate with the doctor during the appointment and will explain the doctor´s assessment to the Patient. The number of appointments covered is limited to three appointments per month, with a maximum time of two hours per appointment. If the time exceeds two hours, the Patient will be charged for the extra time separately as per the rates set in 2.2. Unless the appointment has been made through Care for Me, the Patient needs to give notice of the appointment at least two weeks in advance to ensure availability of one of the employees of Care for Me.

1.6. Monitor the patients check-up.

2. Price of Services. Rates for Extra Assistance.

2.1. The price for the services listed above would be of thirty five euros (35€), with a maximum of three assistance to appointments, with a maximum duration of 2 hours.

2.2. If the assistance requested by the Patient exceeds of three appointments, the rate for the extra appointments would be of 29.75€, with a maximum duration of two hours.

2.3. If the appointment exceeds the two hours allocated, the extra hours would be charged at 29.75€ per hour. The complete hourly rate would be applied for periods under 60 minutes.

3. Payment.

Fees for services rendered are payable upon receipt of invoice. Payment may be made by check, transfer or by credit card. Proof of payment must be sent to the postal or e-mail address noted above.

Hospital Assistants are not permitted to accept payment. An account is considered overdue if not paid within five days of the billing day, and interest would accrue from the day the payment is due at the rate of 1% per month (12% per year).

Care for me may discontinue providing the services until the account is paid in full, including any additional charges and accrued interest. Any bank fees for checks or direct debit returned, would be charged to the Patient with an increase of a 10%.

4. Duration.

This agreement will be effective from the date of the signing and will have a duration of one year. This agreement will automatically renew at the end of each year for a further term of unless either the Patient gives written notice of termination at least 30 days prior to the end of the year or Care for Me gives the Patient written notice of termination at least 60 days prior to the end of the year.

Prices may be subject to change after the end of the year. Care for me will inform the patient 60 days before the end of each year.

5. Termination.

Either party may terminate this agreement upon notice in writing within two weeks, if the other is in breach of any of their obligations.

6. Cancellations

Cancellations may be made up to 24 hours in advance of a scheduled visit without charge. We reserve the right to charge for assistance if sufficient notice is not given.

In the event that a referred Hospital Assistant fails to arrive to the Hospital, we will make every effort to find a replacement as quickly as possible. If a replacement is not found or if the Hospital Assistant alters the predetermined scheduled, we will ad-just the amount that you are billed accordingly.

7. Applicable Law & Dispute Resolution.

This Agreement shall be governed, interpreted and construed in accordance with the Laws of Spain. Any and all disputes arising in connection with this contract, when not settled amicably, shall be submitted to the Courts of Marbella.

8. Transportation.

Transportation of the Patient to/from the Hospital is not included in this contract.

9. Data Protection.

In accordance with the Organic Law 15/1999 on the Protection of personal data, you are informed that the personal data provided will be included in a file owned by CARE FOR ME SL, duly registered with the Spanish Agency of Data Protection and whose purpose is to manage the provision of the required nursing sanitary service and comply with the legal obligations derived from the activity of our entity.

The data provided might be also provided to your Doctor/GP/Specialist, as you instruct us, when necessary for treatment, with the sole purpose of providing the health service.

We inform you that the data will be treated with the confidentiality required in this. This document complies with the duty of legal information required by the data protection regulations and, with its signature, gives its consent to the processing of its data for the purposes set forth above.

We also inform you that by providing us with your details, you expressly agree that they may be transferred to the parent company located in Ireland, whose data are:

For business policy issues, the company works closely, sharing customer data. Therefore transfer of your data is carried out with the sole purpose of properly man-aging and providing the service concerned.
